Domestic violence is an issue in many marriages and other relationships, although by no means all. The court in a divorce proceeding or in an independent proceeding may make an order protecting the victim of domestic violence from contact with or harassment by the perpetrator of the violence. The protection can extend to children or other persons sharing the residence of the protected person.
These orders also may include a residence exclusion (kick-out) order requiring the perpetrator to move out of the joint residence, an order prohibiting phone or personal contact by the perpetrator with the victim, and an order that the perpetrator stay a specified distance from the victim. Such an order is commonly referred to as a “CLETS” order.
A charge of domestic violence can have serious consequences to the person restrained by the CLETS order. A finding that a person has committed domestic violence affects that person’s right to have firearms in their possession or control, which may affect their ability to work in law enforcement. Furthermore, a finding of domestic violence will also be considered by the court in determining spousal support and in making child custody and visitation orders. However, a charge of domestic violence that is found not to be supported by the evidence may be the basis for an award of sanctions or for a change in custody of the children.
